Amendments to the Polish Electronic Communication Law (ECL)

The Polish Government is developing amendments to the Electronic Communication Law (ECL) in order to transpose the European Electronic Communications Code (EECC) into Polish Law. As part of their amendments, the Polish Government is considering updating national surveillance law to extend obligations to OTTs. These obligations could include a requirement to provide Polish authorities with access to user content. For end-to-end encrypted services to disclose the contents of the users’ messages , they will be forced to undermine the security of their users by building vulnerabilities (also known as “encryption backdoors“) into their services.
